TERMS OF THE LICENSE FOR THE MASSIVE SMS, VIRTUAL HANDSET, MMS PHOTO, MMS MIDI OR MMS WEBCHAT PROGRAM, FOR SENDING SHORT TEXT MESSAGES, LOGOS, AND OTHER CONTENTS TO MOBILE TELEPHONES OF ANY NATIONWIDE MOBILE COMMUNICATION PROVIDER.- LLEIDANET grants the user a non-exclusive license to use this MASSIVE SMS program for his/her own personal use or for internal business purposes. The user cannot distribute for commercial purposes, sublicense, resell, or transfer under any circumstances, nor reproduce for the beforementioned purposes, this MASSIVE SMS, MMS PHOTO, MMS MIDI or MMS WEBCHAT program or any modification or derivations of it, whether isolated or jointly with any other product or program. Furthermore, the user cannot change the MASSIVE SMS, VIRTUAL HANDSET, MMS PHOTO, MMS MIDI or MMS WEBCHAT program, except for his/her own personal use or for internal business purposes.
THE MASSIVE SMS, VIRTUAL HANDSET, MMS PHOTO, MMS MIDI OR MMS WEBCHAT PROGRAM IS PROVIDED TO THE USER "AS IT IS". LLEIDANET DOES NOT OFFER ANY GUARANTEE, EXPLICIT OR IMPLIED, REGARDING THIS PROGRAM FOR WINDOWS (95/98/ME/NT/2000/XP VERSIONS) AND/OR RELATED MATERIALS PROVIDED TO THE USER, INCLUDING WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. LLEIDANET DOES NOT GUARANTEE THAT YOUR NEEDS WILL BE SATISFIED BY THE CHARACTERISTICS OF THIS PROGRAM, NOR THAT THE OPERATION OF THE PROGRAM WILL BE UNINTERRUPTED OR FREE FROM ERRORS, NOR THAT THE DEFECTS OF THE PROGRAM WILL BE CORRECTED. FURTHERMORE, LLEIDANET DOES NOT GUARANTEE THE UTILIZATION OR RESULTS ARISING FROM THE USE OF THE AFOREMENTIONED PROGRAM OR OF ANY DOCUMENTS FACILITATED WITH IT FOR THE PURPOSE OF CORRECTING IT, OF ACCURACY, RELIABILITY OR ANY OTHER. NO INFORMATION OR ADVICE, WHETHER SPOKEN OR
WRITTEN, OBTAINED BY YOU FROM AN AUTHORIZED REPRESENTATIVE OF LLEIDANET, SHALL REPRESENT A GUARANTEE AND IN ANY CASE SHALL INCREASE THE SCOPE OF THIS
WARRANTY.
New Terms of Service (December 15th 2009)
Lleida.net service is offered by means of credit packages, paid in advance and they do not expire. LLEIDA.NET will deduct to the CUSTOMER the amount of thirty(30) credits on a monthly basis for the user's account maintanence, from the second month. Should a CUSTOMER have more than one Virtual number, additonal 30 credits will be deducted from each number.
If your credit balance is over, there is a sixty(60) days grace period. LLEIDA.NET reserves the right to deactivate the user and to free the allocated number, if no action has been taken by the CUSTOMER within the before mentioned grace period. The company shall not be liable for any claim, even when the account has been charged.
ELECTRONIC COMMERCE LAW.- The user of the program ACCEPTS, pursuant to the pertinent provisions of the sections 21 and 22 of the "SPANISH LAW OF INFORMATION SOCIETY SERVICES AND ELECTRONIC COMMERCE" (LEY DE SERVICIOS DE LA SOCIEDAD DE LA INFORMACIÓN Y DE COMERCIO ELECTRÓNICO), (Law 34/2002, of 11 July - Official Spanish Gazette (B.O.E.) 12 July 2.002
-), that he/she shall not be able to use this program for sending massive messages (spam, advertising, promotional, commercial messages) without the prior formal consent of or expressly authorized by each one of the recipients, nor to send messages that due to their purpose or contents could be deemed to constitute a breach of law, morality or to be establishing a major or minor offence as well as those that could damage the rights or the image of LLEIDANET or of third parties.
PERSONAL DATA PROTECTION.- LLEIDANET informs the user that the utilization of the MASSIVE SMS, VIRTUAL HANDSET, MMS PHOTO, MMS MIDI OR MMS WEBCHAT program entails that the information linked to the messages is electronically transmitted through the SMS gateway managed by LLEIDANET, to which the user can also have access with regard to the transmission of his/her messages. The purpose of this record is solely the tracking and control of the messages sent by the user, for invoicing the user for the service of sending the before mentioned kind of messages.
Pursuant to the pertinent provisions of the section 12 of the ORGANIC LAW 15/1999, OF 13 DECEMBER, ON "PERSONAL DATA PROTECTION" (PROTECCIÓN DE DATOS DE CARÁCTER PERSONAL) [Official Spanish Gazette (B.O.E.) 14 December 1999], LLEIDANET undertakes to treat the personal information of the users solely for the purpose, aforementioned, of managing the invoicing of the service of message transmission to mobile telephones and in order to apply the security measures required by the ROYAL DECREE 1720/2007, OF 21 JUNE, by means of which "The SPANISH ORGANIC LAW 15/1999 OF 13 DECEMBER ON THE PROTECTION OF PERSONAL DATA WAS APPROVED [Official Spanish Gazette (B.O.E.) 19 January 2008]. Once the rendering of services of messages transmission between the user and LLEIDANET has finished, the personal data shall be eliminated from the record.
LIABILITY LIMITATION.- LLEIDANET AND ITS REPRESENTATIVES DO NOT ACCEPT ANY LIABILITY WHATSOEVER FOR ANY KIND OF CLAIM OR DAMAGE CAUSED TO THE USER OR THIRD PARTIES THAT MAY ARISE FROM USING THIS PROGRAM, INCLUDING DAMAGES TO THE PROPERTY, PERSONAL DAMAGES, INFRINGEMENTS TO INTELLECTUAL PROPERTY RIGHTS OR ANY OTHER REGULATIONS THAT MAY APPLY, BUSINESS INTERRUPTION, OR ANY CONSEQUENTIAL DAMAGES.
